These Terms & Conditions, also referred to as “Terms of Use,” are entered into by and between you and Black AI Film Festival (“Company,” “Festival,” “we,” “us,” or “our”).
These Terms govern your access to and use of our website, event registration pages, livestreams, digital screenings, festival programming, film submissions, generative art drops, downloads, communications, and any other content, functionality, products, or services offered by Black AI Film Festival, whether as a visitor, registrant, filmmaker, creator, sponsor, partner, or participant.
By using our website, registering for an event, submitting a film, accessing a livestream, downloading content, or engaging with any Black AI Film Festival experience, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree with these Terms, do not access or use our website, events, livestreams, or services.
1. Who We Are

We are not liable if all or part of the website, livestream, event platform, or digital experience becomes unavailable for any reason.
To access certain parts of the website or events, including livestreams, film screenings, submission portals, or digital downloads, you may be asked to provide registration details or other information. You agree that all information you provide is accurate, current, and complete.
You are responsible for maintaining the confidentiality of any login credentials, access links, passwords, or private registration information provided to you.
Do not share private livestream links, passwords, access credentials, or restricted festival content without written permission from Black AI Film Festival.
6. Event Registration and Access Links
When you register for a Black AI Film Festival event, livestream, digital screening, or online experience, you may receive access links, email confirmations, reminders, digital downloads, or other event-related materials.
You are responsible for checking your email, including spam, promotions, updates, or junk folders, to locate event access details.
We are not responsible for missed event access due to incorrect email addresses, email delivery issues, spam filters, or failure to check your inbox.
Access links may be personal to you and may not be sold, transferred, publicly posted, redistributed, or shared unless we provide written permission.
7. Free Events, Paid Events, and Digital Products
Black AI Film Festival may offer free events, paid events, digital screenings, livestreams, downloadable content, generative art drops, workshops, courses, merchandise, or other digital products.
Unless otherwise stated at the time of purchase or registration, all sales for digital products, paid access, downloadable content, and livestream experiences are final.
Because many Black AI Film Festival offerings are digital, time-sensitive, downloadable, or immediately accessible, refunds may not be available once access has been delivered or the event has begun.
If a separate refund policy is posted on a specific event page, ticketing platform, or checkout page, that event-specific refund policy will control.
8. No Unlawful or Prohibited Use
You agree not to use our website, livestreams, event platforms, submission portals, downloadable content, or services for any unlawful, harmful, abusive, fraudulent, or prohibited purpose.
You may not:
- Interfere with or disrupt the website, livestream, event platform, or services
- Attempt to gain unauthorized access to private areas, accounts, systems, or data
- Share, sell, or redistribute private livestream links or restricted content
- Upload viruses, malware, harmful code, or disruptive files

- Use the website or event experience to promote spam, scams, unauthorized advertising, or unlawful content
- Record, reproduce, distribute, or monetize screenings, livestreams, or festival content without written permission
The source Terms include similar restrictions against unlawful use, interference with website operations, and unauthorized access to materials. This updated version applies those protections to festival programming and livestream access.
9. Intellectual Property
All Black AI Film Festival content, including but not limited to our name, logos, graphics, website copy, brand materials, event descriptions, videos, digital downloads, generative art drops, promotional materials, programming materials, and curated festival experiences, is owned by Black AI Film Festival or used with permission.
You may not copy, reproduce, modify, distribute, sell, publish, display, perform, create derivative works from, or exploit any Black AI Film Festival content without prior written permission.
All third-party names, logos, films, artworks, music, images, platforms, trademarks, and creative works remain the property of their respective owners.
Nothing in these Terms gives you ownership rights in Black AI Film Festival’s intellectual property or the intellectual property of participating filmmakers, artists, creators, partners, or sponsors.
10. Film Submissions and Creator Materials
If you submit a film, video, image, artwork, bio, headshot, synopsis, trailer, poster, generative art, written description, or other creative material to Black AI Film Festival, you represent and warrant that:
- You own the rights to the submission or have obtained all necessary rights, permissions, licenses, and releases
- Your submission does not infringe upon the rights of any third party
- Your submission does not violate copyright, trademark, privacy, publicity, contract, or other legal rights
- You have secured any required permissions for music, voices, images, likenesses, AI-generated content, archival materials, actors, collaborators, and underlying works
- You have the authority to submit the work to Black AI Film Festival
By submitting materials, you grant Black AI Film Festival a limited, non-exclusive, worldwide, royalty-free license to review, store, display, promote, reproduce, publish, stream, excerpt, edit for promotional purposes, and otherwise use your submission in connection with festival programming, marketing, event listings, social media, press, livestreams, recap content, digital showcases, and related festival activities.
You retain ownership of your original creative work unless a separate written agreement states otherwise.
We are not required to accept, screen, publish, promote, or return any submission.
The original Terms included a “Materials Provided to the Websites” section granting permission to use submitted materials and requiring the submitter to confirm they control the rights. This version makes that language more specific to film submissions, creator materials, AI films, and festival promotion.
11. AI-Generated Content
Black AI Film Festival celebrates creators working with artificial intelligence, generative tools, emerging media, and new cinematic workflows.
If you submit or share AI-generated or AI-assisted content, you are responsible for ensuring that your use of AI tools, datasets, models, prompts, images, voices, music, likenesses, and outputs complies with applicable laws, platform rules, licensing terms, and third-party rights.
Black AI Film Festival does not guarantee that AI-generated content submitted by creators is free from copyright, licensing, authorship, ethical, or ownership concerns.
You remain fully responsible for the content you submit, including any AI-generated or AI-assisted elements.
12. Generative Art Drops and Digital Downloads
Black AI Film Festival may provide registrants or participants with generative art drops, digital downloads, wallpapers, posters, event materials, or other creative assets.
Unless otherwise stated in writing, these materials are provided for personal, non-commercial use only.
You may not sell, mint, tokenize, redistribute, alter for resale, commercially exploit, or claim ownership of Black AI Film Festival digital drops, art assets, or downloadable materials without written permission.
13. Livestreams, Screenings, and Recordings
Black AI Film Festival may host livestreams, recorded events, panels, screenings, interviews, workshops, and digital showcases.
You may not record, download, screen capture, livestream, rebroadcast, distribute, sell, or publicly share festival screenings, livestreams, panels, or digital events without written permission.
We may record festival events, livestreams, panels, workshops, chats, interviews, and audience interactions for archival, promotional, educational, editorial, or commercial purposes.
By attending or participating in a Black AI Film Festival event, you consent to being photographed, recorded, filmed, livestreamed, or otherwise captured and grant us the right to use your name, image, likeness, voice, comments, and participation in connection with festival promotion, recap content, press, social media, and related materials.
14. Community Conduct
Black AI Film Festival is a space for bold storytelling, cultural imagination, innovation, and respectful exchange.
You agree not to engage in conduct that is abusive, discriminatory, threatening, harassing, defamatory, hateful, exploitative, or disruptive.
We reserve the right to remove attendees, block users, delete comments, restrict access, reject submissions, or terminate participation if we determine that someone has violated these Terms or acted in a way that harms the festival, creators, attendees, staff, partners, or community.
15. Communication Services and User Interaction
Our website or event platforms may include chat areas, comment sections, community spaces, livestream comments, submission forms, Q&A tools, forums, or other communication features.
You agree to use these communication services only for lawful, respectful, and event-related purposes.
You may not post or share content that is defamatory, obscene, infringing, abusive, threatening, harassing, spammy, misleading, unlawful, or otherwise inappropriate.
We reserve the right to monitor, edit, remove, refuse to post, or restrict any user content at our sole discretion.

16. Third-Party Websites, Platforms, and Services
Black AI Film Festival may use or link to third-party websites, platforms, tools, livestream providers, registration platforms, payment processors, social media platforms, video hosts, AI tools, sponsor pages, filmmaker websites, or partner services.
We do not control third-party websites or services and are not responsible for their content, policies, availability, actions, or practices.
Your use of third-party platforms may be governed by their own terms and privacy policies.
The original Terms included a third-party links section clarifying that linked websites are not under the company’s control and that third-party services may be used to deliver functionality. This updated version preserves that protection for festival platforms and streaming tools.
17. Educational and Informational Purposes Only
Festival programming, creator conversations, panels, articles, livestreams, downloads, AI discussions, and other materials are provided for educational, informational, cultural, and entertainment purposes.
Nothing provided by Black AI Film Festival should be understood as legal, financial, tax, investment, medical, technical, or professional advice.
You are responsible for seeking qualified professional advice before making decisions based on information shared during festival programming or through our website.
18. No Guarantees
Black AI Film Festival does not guarantee any specific outcome from attending an event, submitting a film, participating in a showcase, downloading materials, using AI tools, networking with creators, or engaging with our programming.
We do not guarantee that participation will result in selection, exposure, funding, distribution, sales, partnerships, employment, press, audience growth, or professional opportunity.
Your results depend on your own work, circumstances, decisions, market conditions, and factors beyond our control.
19. No Warranties
Our website, livestreams, events, digital content, downloads, submission portals, screenings, and services are provided “as is” and “as available.”
We make no warranties, express or implied, regarding the operation, availability, accuracy, reliability, suitability, or performance of the website, livestream, event platform, screenings, downloads, or services.
We do not guarantee that the website, livestream, digital content, or services will be uninterrupted, secure, error-free, or free from harmful components.
The source Terms included broad “no warranties” language covering website performance, materials, services, accuracy, and availability. This version adapts that structure for the festival’s digital events and livestreams.
20. Limitation of Liability
To the fullest extent permitted by law, Black AI Film Festival and its owners, officers, directors, employees, contractors, volunteers, affiliates, partners, sponsors, service providers, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or other damages arising out of or related to:

21. Indemnification
You agree to indemnify, defend, and hold harmless Black AI Film Festival and its owners, officers, directors, employees, contractors, volunteers, affiliates, partners, sponsors, service providers, and representatives from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

22. Termination and Access Restriction
We may terminate, suspend, restrict, or block your access to our website, livestreams, events, submissions, community spaces, downloads, or services at any time, without notice, if we believe you have violated these Terms or acted in a way that may harm Black AI Film Festival, its community, creators, attendees, partners, sponsors, or service providers.

23. Arbitration and Dispute Resolution

You waive any right to participate in class arbitration or class action litigation to the fullest extent permitted by law.

24. International Users
Black AI Film Festival is operated from the United States.
If you access our website, livestreams, events, submission portals, or services from outside the United States, you are responsible for compliance with your local laws.

25. No Joint Venture, Partnership, or Employment Relationship
Your use of our website, participation in an event, submission of a film, sponsorship discussion, creator feature, or attendance at festival programming does not create a joint venture, partnership, employment, agency, fiduciary, or representative relationship between you and Black AI Film Festival.
No attendee, filmmaker, creator, sponsor, partner, moderator, guest, or volunteer is authorized to act as a spokesperson or legal representative for Black AI Film Festival unless expressly authorized in writing.
26. Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted to best accomplish the original intent, and the remaining provisions will continue in full force and effect.
27. Entire Agreement
These Terms, together with our Privacy Policy and any event-specific rules, submission guidelines, ticketing terms, or written agreements, constitute the entire agreement between you and Black AI Film Festival regarding your use of the website, events, livestreams, submissions, digital content, and services.
These Terms supersede all prior or contemporaneous communications, whether electronic, oral, or written, regarding the same subject matter.
